Introduction
Welcome to ToGatherSG! Thank you for using the ToGatherSG mobile app and website ("Platform"), operated by ToGatherSG LLP ("ToGatherSG", "we", "us" or "our"). The Platform is made available to you on the condition that you accept and comply with these Terms. By accessing or using the Platform, you agree to these Terms & Conditions ("Terms").
"Users" refers to individuals who browse, book, or participate in any Experience listed on the Platform.
"Hosts" refers to individuals or businesses who create listings, offer, organise, or conduct Experiences through the Platform. Users and Hosts are collectively referred to as "Members".
These Terms apply to all Users and Hosts. You must be at least 13 years old to use the Platform. By accessing or using the Platform, you represent and warrant that you have the legal capacity to enter into these Terms and, where you act on behalf of an entity, that you are authorised to bind that entity, and you agree that our collection, use and disclosure of personal data is governed by our Privacy Policy, which forms part of these Terms. Hosts acknowledge that, to the extent they separately collect or use personal data about Users outside the Platform (for example, by exporting contact lists or using their own systems), they do so as independent organisations under applicable data protection laws and are solely responsible for their own compliance.
Scope of Services
ToGatherSG is an online marketplace enabling Users to discover, book and review home-based workshops, dining sessions, classes and activities ("Experiences") offered by Hosts. ToGatherSG does not itself provide, own, operate or manage any Experiences. We do not operate, supervise, control or guarantee any Experiences. Host content may appear on partner sites or be translated or reformatted and we do not guarantee accuracy. ToGatherSG may, in its sole discretion, decide to verify certain information or highlight certain Experiences, but such actions do not amount to an endorsement, guarantee or assumption of responsibility for any Experience. ToGatherSG uses reasonable technical and organisational measures to provide the Platform, but does not warrant that the Platform will be uninterrupted, secure or free from errors, viruses or other harmful components. Access to the Platform may be suspended, limited or unavailable from time to time, and ToGatherSG shall not be liable for any loss of data, revenue or opportunity resulting from any such interruptions, except to the extent required by law.
Registration Requirements
Users must register with a username, password, email and mobile number, or they may sign up using their Apple or Google account for authentication. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. Hosts must additionally provide business information, photos, social links and the address or location where their Experience is conducted. All information provided must be accurate, complete and kept updated at all times. You must promptly update your account information if it changes, and ToGatherSG may suspend or terminate your account if any information is inaccurate, misleading or incomplete.
Platform Role & Disclaimer
ToGatherSG only facilitates connections between Members through the Platform. Hosts are fully responsible for Experience delivery, safety, legal compliance and accuracy of listings. Users acknowledge that Experiences may also occur in private residences, which may not be covered under commercial public liability insurance and that they enter at their own risk. ToGatherSG does not and will not supervise Experiences in person, assess the suitability of any premises, or provide any equipment, supervision or safety services.
Not a Party to Contracts
ToGatherSG is not a party to any agreement between Users and Hosts. All obligations, risks and liabilities relating to Experiences are solely between Users and Hosts. ToGatherSG is not responsible for Host performance or User behaviour. Any booking, participation, payment, cancellation, modification or dispute relating to an Experience is strictly between the relevant User(s) and Host, and ToGatherSG is not an agent, partner, joint venture or employer of any Host or User.
No Screening or Background Checks
ToGatherSG does not verify Host qualifications, backgrounds, criminal history, safety standards, premises suitability, identity or licensing compliance unless expressly stated. Users participate solely based on Host-provided information. Any optional checks or badges displayed on the Platform are limited and do not replace your own due diligence. ToGatherSG makes no representation that any Member has passed any particular check.
Assumption of Risk
Users understand that Experiences may involve the use of kitchen tools, heat sources, sharp objects, chemicals, pottery equipment, crafting tools, physical movement, outdoor activities, allergens, pets, uneven floors and other household hazards. Experiences may also involve interaction with other Members and third parties outside ToGatherSG's control. Users voluntarily assume full responsibility for all risks. By booking or participating in any Experience, you acknowledge that you have independently assessed the risks involved and decided whether to participate, and you agree that, to the maximum extent permitted by law, you participate at your own sole risk.
No Warranty
ToGatherSG does not warrant the safety, legality, suitability, availability or quality of any Experience. Experiences are provided "as is", and participation is at the User's sole risk. ToGatherSG disclaims all representations, warranties and conditions, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, accuracy and any warranties arising out of course of dealing or usage of trade.
Accuracy of Information
We strive for accuracy but do not guarantee that listings are complete, updated or error-free. ToGatherSG is not responsible for typographical errors, pricing errors, availability, or any inaccuracies or omissions in listings or other Member-generated content. Any guides, FAQs, blog posts, marketing materials or other non-contractual content made available by ToGatherSG are provided for general information only and do not form part of these Terms unless expressly stated.
Intellectual Property / Content Moderation
All Platform content is owned or licensed by ToGatherSG. Photos or videos taken during Experiences may be used for marketing unless Users request otherwise. By uploading, posting or otherwise providing any content (including photos, descriptions, reviews and logos) on or through the Platform ("Member Content"), you grant ToGatherSG a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to use, reproduce, adapt, modify, translate, publish, display and distribute such Member Content in any media for the purpose of operating, promoting and improving the Platform. You represent and warrant that you have all rights necessary to grant this licence and that your Member Content does not infringe any third-party rights.
Reviews, ratings and other Member Content reflect the opinions of individual Members only and not ToGatherSG. We do not undertake to screen Member Content in advance but may, in our sole discretion, edit, hide or remove any content that we consider to be inaccurate, misleading, unlawful, offensive or otherwise harmful, without being obliged to do so in any particular case.
Fees & Payments / Third-Party Services
Hosts may be charged a commission. Users' payments are processed through third-party vendors, and ToGatherSG is not liable for failures caused by these providers. By making a booking, you authorise ToGatherSG and its payment processors to charge your selected payment method for the total price of the booking (including any applicable taxes and fees). ToGatherSG may withhold, offset or recover any amounts owed to ToGatherSG or other Members from amounts payable to you.
The Platform may link to, or integrate with, third-party sites, applications and services (including payment, messaging, mapping and marketing tools). These services are operated by third parties, not ToGatherSG, and your use of them may be subject to separate terms and privacy policies. ToGatherSG is not responsible for, and does not endorse, any third-party services, and shall not be liable for any loss arising from your use of them.
Booking Terms
A booking is confirmed when payment is completed and confirmation is issued. Users booking for others must ensure all participants meet requirements. By making a booking on behalf of additional participants, you represent that you are authorised to act on their behalf and that they have read and agreed to these Terms and any Experience-specific requirements. Hosts may refuse participation or require additional consents where a participant does not meet the stated requirements.
Cancellations & Refunds
Users who cancel at least 24 hours before the scheduled start time of an Experience will receive a full refund. No refunds will be provided for cancellations made within 24 hours of the Experience's start time. If a Host cancels, the User will receive a full refund. All complaints and refund requests will be reviewed at ToGatherSG's discretion. ToGatherSG may, but is not obliged to, facilitate refunds or alternative arrangements and reserves sole discretion to deviate from the above policy in exceptional cases (for example, safety issues or verified emergencies). Any decision by ToGatherSG to provide a refund or credit does not create any obligation to do so in the future.
Host Responsibilities
Hosts must comply with all laws, safety rules, licensing, HDB/URA guidelines, fire safety, hygiene and alcohol regulations. They must ensure a safe and clean environment and verify they are legally permitted to host from their premises. ToGatherSG does not verify property legality. Hosts are solely responsible for:
- (a) obtaining and maintaining all licences, permits, approvals and insurance required for their Experiences and premises
- (b) ensuring that Experiences are suitable for the advertised participants (including any age or health limitations)
- (c) providing accurate, non-misleading descriptions of Experiences, prices and any additional charges
- (d) fully educating and informing Users, in the relevant listing, about:
- (i) any risks inherent or incidental to the Experience
- (ii) any requirements for participation (such as minimum age, related skills or level of fitness)
- (iii) any locations where the Experience may lawfully be performed
- (iv) any applicable licences, permits, certifications or registrations the Host holds for the Experience
Hosts must retain and keep up to date the documentation needed to verify their licences, permits, certifications and registrations, and must promptly provide copies to ToGatherSG upon request. Hosts must immediately notify ToGatherSG if any required licence, permit, certification or registration expires, is revoked, or otherwise ceases to be valid, or if they become aware that their Experience or listing may no longer comply with applicable laws or any agreement they have with a third party.
Hosts must, at their own cost, obtain and maintain in full force and effect any insurance that a reasonable provider of similar experiences would carry (including, where available, public liability and product liability insurance), and acknowledge that ToGatherSG does not arrange or provide any insurance coverage for Hosts or Users in relation to any Experience. Any information about licences or insurance displayed on the Platform is provided by Hosts and is not verified by ToGatherSG. Hosts are solely responsible for all acts and omissions of any person they involve in providing an Experience, and for leaving any premises, facilities, common areas and personal property used in connection with an Experience in at least the condition in which they were first provided.
Tax Responsibilities
Hosts are solely responsible for determining and fulfilling their tax obligations in relation to their use of the Platform, including any goods and services tax, income tax or other taxes, and ToGatherSG may issue invoices or receipts on a Host's behalf solely as a billing tool without assuming any responsibility for tax treatment.
Host earnings are taxable under Singapore law. Hosts must declare income to IRAS and meet tax obligations. ToGatherSG does not provide tax advice.
Prohibited Conduct
Members must not post false information, engage in unlawful activities, harass others, scrape data, use bots or violate intellectual property. Violations may result in account suspension or termination and may be reported to law enforcement where appropriate.
Termination & Suspension
ToGatherSG may suspend or terminate your account at any time for breaches, safety concerns or with notice for operational reasons. You may also close your account at any time. Termination does not waive obligations, indemnities or liabilities that arose before termination, and sections intended to survive (including those relating to liability, indemnification, dispute resolution and data retention) will remain in effect.
Limitation of Liability
To the maximum extent permitted by law, ToGatherSG and its affiliates, directors, employees and service providers shall not be liable for indirect, incidental, consequential, punitive or exemplary damages, including loss of profits, revenue, data or business opportunities, arising from or related to your use of the Platform or any Experience. In jurisdictions where such exclusions are not permitted, ToGatherSG's total liability shall be limited to the lesser of (a) SGD 100 or (b) the total amounts actually paid by you to ToGatherSG in the 12 months preceding the claim. Nothing in these Terms excludes or limits ToGatherSG's liability for death or personal injury caused by its negligence, fraud or any other liability that cannot be excluded or limited by applicable law.
Indemnification
You agree to indemnify, defend and hold harmless ToGatherSG and its affiliates, officers, directors, employees, contractors and agents from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform or any Experience; (b) your breach of these Terms or any applicable laws; (c) your violation of any third-party rights; or (d) if you are a Host, any Experience you offer, including any injury, loss or damage suffered by any User or third party.
Dispute Resolution & Governing Law
These Terms are governed by the laws of Singapore. Any disputes arising from or related to these Terms or your use of the Platform shall be resolved by the courts of Singapore, and you consent to the exclusive jurisdiction of those courts. ToGatherSG may seek injunctive or other equitable relief in any court of competent jurisdiction where necessary to protect its intellectual property or other proprietary rights.
General Provisions
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. ToGatherSG's failure to enforce any right or provision shall not constitute a waiver. You may not assign or transfer these Terms without ToGatherSG's prior written consent, but ToGatherSG may assign or transfer these Terms (in whole or in part) without restriction. These Terms (including the Privacy Policy and any other documents expressly incorporated by reference) constitute the entire agreement between you and ToGatherSG regarding the Platform and supersede all prior agreements or understandings.
Amendments
ToGatherSG may update these Terms from time to time. Material changes will be communicated via email or Platform notification where required by law, and your continued use after such notice constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Platform.
